END USER LICENSE AGREEMENT & TERMS AND CONDITIONS — [July 23th 2026].
This End User License Agreement (“Agreement”) is a legal agreement between you (“User” or “you”) and Biosignals Solutions (“Developer,” “we,” “us,” or “our”) governing your use of the application, including its associated content, services, updates, reports, algorithms and features (“App”). By downloading, installing, accessing or using the App, or accessing App web, you confirm that you have read, understood and accepted this Agreement and our Privacy Policy. If you do not agree, do not install or use the App or use the BeatExplorer wep application.
1. ACKNOWLEDGEMENT.
This Agreement is concluded solely between you and Biosignals Solutions.
2. LICENSE.
Subject to your compliance with this Agreement, Biosignals Solutions grants you a limited, personal, non-exclusive, non-transferable and revocable license to use the App on App Store -branded products that you own or control, as permitted by the applicable App Store Usage Rules. The App is licensed, not sold. You may not copy, distribute, sublicense, rent, lease, sell, transfer, modify, reverse engineer, decompile, disassemble, attempt to derive the source code of, circumvent security mechanisms in, or create derivative works from the App.
3. PURPOSE OF THE APP.
The App is intended to record, display, store, process, analyse, export and transmit signal and fitness information obtained from compatible sensors, including biologic signals, heart rate, heart-rate variability and related measurements. The App may generate statistical values, estimations, indicators, graphs, reports and files based on recorded signals and mathematical algorithms. Measurements, calculations, classifications, and reports generated by the Application may be affected by sensor placement, movement, signal quality, interference, device performance, user characteristics, and other factors. Compatibility, signal quality and available functions may depend on the sensor, firmware, device, operating system, connection conditions and selected subscription plan.
4. EDUCATIONAL AND INFORMATIONAL USE.
The App is also intended for educational and informational purposes. It may be used to learn about, observe, record and explore biosignals, heart rate, heart rate variability and other related physiological measurements, as well as to understand how such signals may vary over time or under different conditions. The information, measurements, calculations, graphs, indicators, reports and other results generated by the App are provided for educational, informational and general wellness purposes and must not be interpreted as medical advice, a medical diagnosis, a clinical assessment or a recommendation for treatment. The availability of paid subscriptions or other paid features does not change the educational and informational nature of these functions. Subscription fees are charged for access to software functionality, data processing, storage, synchronization, reports and other features of the App, and do not constitute payment for medical advice, diagnosis, treatment, clinical monitoring or healthcare services. Use of the App does not establish a doctor-patient, healthcare professional-patient or other professional healthcare relationship between the User and Biosignals Solutions, its owners, directors, employees, contractors or affiliates. Users remain responsible for how they interpret and use the information provided by the App and should not rely on the App as the sole basis for making medical, health or treatment decisions.
5. IMPORTANT MEDICAL NOTICE.
THE APP IS NOT A MEDICAL DEVICE. THE APP’S WEBISTE IS NOT A MEDICAL DEVICE. THE APP AND APP’S WEBSITE DOES NOT PROVIDE MEDICAL ADVICE AND IS NOT INTENDED TO DIAGNOSE, PREVENT, MONITOR, TREAT OR CURE ANY DISEASE OR HEALTH CONDITION. IT IS NOT A SUBSTITUTE FOR PROFESSIONAL MEDICAL ADVICE, DIAGNOSIS, TREATMENT OR SUPERVISION. THE APP AND WEBSITE IS NOT AN EMERGENCY SERVICE, IS NOT INTENDED FOR LIFE-CRITICAL OR LIFE-SUPPORTING USE, IS NOT DESIGNED FOR CONTINUOUS CLINICAL MONITORING AND DOES NOT AUTOMATICALLY CONTACT, NOTIFY OR ALERT HEALTHCARE PROFESSIONALS, EMERGENCY SERVICES, PATIENTS OR OTHER PERSONS ABOUT POTENTIALLY SERIOUS EVENTS. BIOSIGNAL RECORDINGS, AUTOMATIC DETECTIONS, CALCULATED VALUES AND REPORTS MAY BE INCOMPLETE, DELAYED, EXPERIMENTAL OR INACCURATE because of movement, poor electrode contact, wireless interference, sensor malfunction, incorrect user information, software errors or algorithmic limitations. Do not make medical decisions, change medication, begin or stop treatment, or delay seeking professional care based solely on information produced by the App. Consult a qualified healthcare professional before making decisions concerning your health or exercise programme. If you believe that you may be experiencing a medical emergency, stop using the App and immediately contact the emergency services available in your location.
6. USER RESPONSIBILITIES.
You are responsible for using the App, the device and any connected sensor safely and in accordance with their instructions. You must verify that recordings, exported files and reports are suitable for your intended purpose. Where the App requests information such as age, height, weight, sex or other parameters, inaccurate information may produce inaccurate results. You are responsible for maintaining appropriate backups of any data or files you wish to preserve. The App must not be used as the sole means of storing essential, clinical or legally required information. Researchers, healthcare professionals, rehabilitation centres, trainers and other specialists remain solely responsible for validating the App’s outputs and determining whether its use complies with applicable professional, ethical, institutional and regulatory requirements.
7. SUBSCRIPTIONS AND PURCHASES.
Certain features or usage levels may require an auto-renewable subscription or another in-app purchase. The available plans, duration, price, trial period, limitations and included functionality are displayed before purchase. Subscriptions automatically renew unless cancelled in accordance with the conditions displayed by Store when the subscription is purchased. You can manage or cancel subscriptions through your Store account settings. Deleting the App does not automatically cancel a subscription. Prices may change for future subscription periods in accordance with applicable law and Store’s procedures. Refund requests and billing disputes relating to App Store transactions are handled under App Store applicable policies. Subscription access may require verification of the purchase status through App Store or Biosignals Solutions’ systems, and temporary delays may occur while a transaction is processed or validated.
8. PRIVACY AND DATA.
Use of the App is also governed by the Biosignals Solutions Privacy Policy available at https://biosignalssolutions.com/privacy-policy-polar-ecg-analysis/. Depending on the features used and the permissions granted, the App may process information supplied by you, device and application information, technical logs, sensor identifiers, subscription status, support information and biosignal or fitness data such as biological signals, heart rate and activity information. The Privacy Policy explains what information is collected, the purposes of processing, data retention, security measures, recipients, international transfers where applicable, and how to exercise your privacy rights. Where permitted by law, appropriately anonymised or de-identified data may be used to improve the App, validate algorithms, investigate errors, detect abnormal device behaviour and conduct research or product-development activities. Personal data will only be used for a specific research project when an appropriate legal basis and any required separate consent have been obtained. You must not enter another person’s personal or biosignal data without appropriate authorisation and a lawful basis.
9. THIRD-PARTY DEVICES AND SERVICES.
The App may communicate with or depend on third-party devices, software, operating-system functions, libraries, websites or services. Biosignals Solutions does not control and cannot guarantee the availability, accuracy, security, compatibility or continued operation of third-party products or services. Polar, Polar H10 and related trademarks and product names are the property of their respective owners. Use of a Polar device is subject to Polar’s applicable instructions and terms. References to third-party products do not imply sponsorship, certification or endorsement unless expressly stated.
10. PROHIBITED CONDUCT.
You must not use the App for unlawful, fraudulent, deceptive, abusive or harmful purposes; access another person’s account or data without authorisation; collect, disclose or misuse another person’s personal or related information; infringe intellectual-property or privacy rights; introduce malware or harmful code; interfere with the App, its servers, communications or security mechanisms; attempt to gain unauthorised access to systems or data; manipulate subscription, usage or purchase-verification systems; use automated means to overload or disrupt the service; misrepresent the App’s results as a confirmed medical diagnosis; or use the App in any manner that could create an unreasonable risk of injury or damage. A breach may result in suspension or termination of access.
11. INTELLECTUAL PROPERTY.
The App, its original source code, design, algorithms, reports, graphics, logos, text, databases and other original content are owned by or licensed to Biosignals Solutions and are protected by copyright, trademark and other intellectual-property laws. If you need to publish reports, charts, or results, you may request authorization from Biosignals Solutions.
12. MAINTENANCE AND SUPPORT.
Biosignals Solutions is solely responsible for any maintenance and support services that it chooses or is legally required to provide for the App. App Store has no obligation to provide maintenance or support services for the App. Updates may modify, add, remove or discontinue functions where reasonably necessary for security, compatibility, legal compliance, service improvement or technical reasons. 13. AVAILABILITY AND NO WARRANTY.
THE APP AND RELATED SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITH ALL FAULTS AND WITHOUT EXPRESS, IMPLIED OR STATUTORY WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, RELIABILITY, AVAILABILITY, NON-INFRINGEMENT OR UNINTERRUPTED AND ERROR-FREE OPERATION. WE DO NOT WARRANT THAT THE APPLICATION OR SERVICES WILL ALWAYS BE AVAILABLE, UNINTERRUPTED, SECURE, ACCURATE, OR ERROR-FREE. BIOSIGNALS SOLUTIONS DOES NOT GUARANTEE THAT RECORDINGS WILL BE COMPLETE, THAT SIGNALS WILL BE FREE FROM ARTEFACTS, THAT ALGORITHMS WILL IDENTIFY ALL EVENTS, THAT REPORTS WILL BE ACCURATE OR THAT DATA WILL NEVER BE LOST.
14. LIMITATION OF LIABILITY.
BIOSIGNALS SOLUTIONS AND ITS OWNERS, DIRECTORS, EMPLOYEES, CONTRACTORS AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE OR CONSEQUENTIAL DAMAGES, LOSS OF PROFITS, LOSS OR CORRUPTION OF DATA, BUSINESS INTERRUPTION, LOSS OF OPPORTUNITY OR DAMAGES RESULTING FROM RELIANCE ON AN INACCURATE OR INCOMPLETE RECORDING, CALCULATION OR REPORT. THESE LIMITATIONS DO NOT APPLY TO LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW, INCLUDING ANY LIABILITY ARISING FROM FRAUD, WILFUL MISCONDUCT, GROSS NEGLIGENCE OR MANDATORY CONSUMER-PROTECTION RIGHTS.
15. CHANGES TO THIS AGREEMENT.
Biosignals Solutions may update this Agreement to reflect changes in the App, App Store requirements, security practices or available services. The updated effective date will be displayed with the revised Agreement. Where required material changes will be notified or submitted for renewed acceptance. Continued use after an update becomes effective constitutes acceptance. If you do not accept an updated Agreement, you must stop using the App and the web Application.
